During his career, Mark A. La Mantia has represented the interests of both franchisors and franchisees in matters related to:

 
    - the establishment of franchise systems
  • (e.g. the development of offering circulars and /or registration and disclosure documents (including UFOC documents and FTC and state compliance; franchise agreements; operating manuals)
    - the establishment of franchise relationships and business locations
  • (e.g. franchise agreement review and negotiation, location leasing/purchasing and development - see also this web site under Business Law and Representation)

    - relationship problems, disputes and litigation, including franchise termination

Mr. La Mantia has participated in numerous litigation, arbitration, mediation, and negotiation proceedings nationwide involving franchises and franchise systems. While his background includes extensive experience in the petroleum industry (e.g. representation of the interests of gasoline retailers, wholesale distributors, and others involved in the supply, distribution, and retail sale of gasoline and petroleum products, in relationship claims under the PMPA and other Federal and state law), Mr. La Mantia has also worked on matters involving franchises of many kinds. Some of these include log homes, restaurants and fast food, auto parts, tire and auto services, copy services, staffing and personnel services, hair salons and hair care services, massage therapy, tax preparation services, pharmacies, picture framing and art supplies, and real estate services, to name a few. He has participated in various seminars and presentations concerning the ongoing development of franchise law and related issues, including concepts of good faith and fair dealing, restrictive covenant enforcement, distribution systems, and anti-trust law.
